By entering your mobile telephone number and checking the consent box as part of submitting your insurance policy request form on servebetterautorates.com (the “Site”), you expressly consent to receive both non-marketing and marketing text messages from ServeBetterAutoRates.com (“ServeBetterAutoRates,” “Company,” “we,” “us,” or “our”), including messages sent via an autodialer, at the mobile number(s) you provide. You may opt out at any time. Consent to receive marketing text messages is not required to obtain any services on our Site. Data transmitted as part of this service may also be governed by our Website Terms of Use, Privacy Policy, and any other applicable terms related to your use of Company services.

What is ServeBetterAutoRates.com?

ServeBetterAutoRates.com works with a network of insurance carriers and advertisers who may provide insurance assistance to consumers, generally in the form of a policy or similar products. After a consumer successfully opts in via express written consent, Serve Better Auto Rates may send text messages with information about the submission request and additional goods or services offered by ServeBetterAutoRates.com. The insurance carrier you may be connected with might also contact you electronically to provide information about your insurance request or to verify information as part of underwriting if you are approved (the “Subscription”). Message and data rates may apply. Please check with your carrier for details.

How to Opt Out

If you no longer wish to receive text messages from us, follow the instructions in the message or text STOP or QUIT. For assistance, text HELP. You may receive a confirmation of your opt-out for that program. You may also be provided an unsubscribe link directing you to the website where you initially opted in. Additionally, you can unsubscribe from all future notifications from us by emailing admin@servebetterautorates.com.

Frequency of Messaging

ServeBetterAutoRates.com alerts and notifications are typically delivered via SMS approximately two (2) messages per week.

Access to the Services

To receive notifications, you must have a mobile subscription with a participating carrier or otherwise have access to a mobile network through which ServeBetterAutoRates.com sends notifications, and you must pay any service fees associated with such access. YOUR CARRIER’S TEXT-MESSAGING RATES WILL APPLY TO ALL TEXT MESSAGES SENT OR RECEIVED IN CONNECTION WITH THE SERVICES. All pricing, billing, refund, and related inquiries must be directed to your carrier’s customer support.

Supported carriers include, but are not limited to: AT&T, Verizon Wireless, Sprint, T-Mobile, Alltel, Cellular One, Virgin Mobile, U.S. Cellular, and MetroPCS. Wireless carriers are not liable for delayed or undelivered messages.

You are responsible for providing all equipment and software necessary to participate in the Subscription, including a mobile handset or other device in proper working order.

ServeBetterAutoRates.com reserves the right, at any time and from time to time, to modify, suspend, limit, discontinue, or permanently cancel all or any portion of the Subscription. We use reasonable efforts to keep services available; however, interruptions may occur for maintenance, upgrades, emergency repairs, or failures of telecommunications links and equipment beyond our control.

Your Mobile Telephone Number

You represent that you are the account holder for the mobile number(s) provided with your insurance request. If you are not the account holder, you represent that you have the express permission of the account holder to participate in the Subscription. If you change your mobile number, you must notify us immediately at admin@servebetterautorates.com.

You agree to indemnify the Company for all claims, expenses, and damages arising from your failure to notify Company of number changes, including claims arising under the Telephone Consumer Protection Act (TCPA).

Privacy

Our collection and use of information from you, including your mobile number, is subject to our Privacy Policy, available at servebetterautorates.com/privacy.

Age Requirements and Service Limitations

You must be at least 18 years of age to opt in to notifications. By subscribing, you represent that you are 18 or older. We may terminate any account if we discover the subscriber does not meet this requirement.

You are solely responsible for all security information relating to your Subscription and for all activities that occur under your mobile number.

Changes to These SMS Terms & Conditions

The Company may revise, modify, or amend these SMS Terms & Conditions at any time. Any changes take effect when posted to the Company’s website. You agree to review these terms periodically. Your continued consent to receive Serve Better Auto Rates text messages after changes become effective constitutes acceptance of those changes.

Termination of Text Messaging

The Company may suspend or terminate your receipt of text messages if it believes you have breached these SMS Terms & Conditions. Your receipt of messages may also terminate if your mobile service lapses or ends. The Company may modify or discontinue, temporarily or permanently, all or any part of its messaging programs, with or without notice.

Disclaimer of Warranties

TO THE EXTENT PERMITTED BY LAW, WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE SERVICES, APPLICATIONS, OR CONTENT YOU RECEIVE FROM US, AND DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Services offered to the public by ServeBetterAutoRates.com may include inaccuracies, errors, or may not function as anticipated. We are not responsible for circumstances beyond our control, including acts or omissions of others, atmospheric conditions, or acts of God. WE DO NOT PROMISE ERROR-FREE SERVICE AND WILL NOT BE LIABLE FOR ANY DELAYS IN RECEIPT OF SMS MESSAGES as delivery depends on effective transmission by your network carrier.

Limitation of Liability

ServeBetterAutoRates.com is not responsible and will not be liable for any other damages of any nature, including incidental, special, or consequential damages (such as lost profits or business opportunities), punitive damages, or attorneys’ fees.

Applicable Law

Your use of the Services under these SMS Terms & Conditions is governed by the laws of the State of Delaware.

Submissions
